QuaverEd's designated agent is registered with the U.S. Copyright Office and listed in its public DMCA Designated Agent Directory.
- 01 Your signature Physical or electronic, from the copyright owner or a person authorized to act on the owner's behalf.
- 02 Identification of the copyrighted work Tell us what work you believe has been infringed. If you are reporting multiple works covered by a single notice, a representative list is acceptable.
- 03 Identification of the material you want removed Tell us what material is infringing and where it is located, with enough detail that we can find it. Include the exact URL or the specific location within the product wherever possible. A general description of a category of content is not enough.
- 04 Your contact information Name, mailing address, telephone number, and email address.
- 05 A good faith statement A statement that you believe in good faith that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- 06 A statement of accuracy A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
What happens after you submit
- We review the notice We check that it contains all six required elements. If something is missing, we will contact you and explain what we need.
- We remove access to the material For valid notices, we act expeditiously to remove the material or disable access to it.
- We notify the person who uploaded it We provide them a copy of your notice, including your contact information, and explain their right to submit a counter-notice.
- We record the complaint Valid notices are logged against the uploading user's account under our repeat infringer policy.
Submitting a counter-notice
If your material was removed and you believe that was a mistake, you can email dmca@QuaverEd.com. A counter-notice requires five elements, including your contact information and consent to federal jurisdiction. We highly recommend you speak with your district before filing.
- Your signature. Physical or electronic.
- Identification of the material. What was removed, and where it appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, and telephone number.
- A consent to jurisdiction. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, any judicial district in which QuaverEd may be found, and that you will accept service of process from the person who submitted the original notice or from that person's agent.
What happens next
We forward your counter-notice to the person who submitted the original complaint, including the contact information you provide. Unless they notify us within 10 business days that they have filed a court action, we will restore the material in not less than 10 and not more than 14 business days.
Before you file. A counter-notice is a legal document. It requires you to disclose your contact information to the complaining party and to consent to federal jurisdiction. Consider consulting a lawyer, and check with your school or district administrator before filing a counter-notice about material you uploaded in the course of your employment.
Repeat infringer policy
QuaverEd terminates the access of users who repeatedly infringe copyright.
When a user’s uploaded material is removed in response to a valid notice, we record it against that user’s account. A user with more than one recorded complaint may have their upload privileges suspended and their individual account access terminated. Complaints resolved through a successful counter-notice, or withdrawn by the complaining party, are not counted.
For accounts provisioned under a school or district license, termination applies to the individual user account. We notify the account administrator when a user under their license accumulates recorded complaints, and again at termination.
We may terminate access sooner in cases of severe or clearly willful infringement.
False claims
Under Section 512(f) of the Copyright Act, a person who knowingly misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys’ fees.
Permission requests
If you want permission to reuse QuaverEd curriculum materials, that is a separate request and does not go to our Copyright Agent. Contact info@QuaverEd.com instead.
